Goal
The Yergey Family

Four generations. One firm. One purpose.

In 1928, C. Arthur Yergey and Germaine G. Yergey — one of the first female attorneys in Florida — opened a law practice in Orlando. What followed was not a marketing strategy — it was a family. Each generation has served the same Central Florida families through the same core belief: that the people who trust you with their most difficult legal moments deserve to be treated as clients for life.

Meet David A. Yergey III.

David is the Managing Partner of Yergey & Yergey, P.A. and the fourth generation of Yergey attorneys to practice in Orlando. He earned his LL.M. in Taxation from the University of Alabama, holds Florida Supreme Court certification as a Circuit Court Mediator, and taught Wills & Trusts as a Former Adjunct Professor at FAMU College of Law.

He's been recognized by Thomson Reuters as a Super Lawyers Rising Star three years running, and serves as Founding President of the Florida Guardianship Support Network — a nonprofit he co-founded in response to systemic gaps in Florida's professional guardian oversight system.

Why Families Choose Yergey & Yergey

Probate is not one-size. Neither is the firm you bring to it.

A small estate with a cooperative family takes a different path than a contested formal administration with will challenges, creditor disputes, and a reluctant personal representative. Our attorneys have handled both — and every degree of complexity in between — across Orange County and the surrounding circuits for nearly a century.

  • Fourth-generation continuity since 1928

    C. Arthur Yergey and Germaine G. Yergey — one of the first female attorneys in Florida — founded this firm in Orlando in 1928. Four generations of the Yergey family have appeared in Orange County Probate Division proceedings across every era of Florida's probate code. That depth of court familiarity is not replicated by a firm founded in the 2000s.

  • LL.M. in Taxation

David A. Yergey III holds a Master of Laws in Taxation from the University of Alabama (2018). The LL.M. matters in estates with federal estate tax exposure, portability elections, step-up basis planning, and multi-generational trust structures.

  • Probate litigation capability

We actively litigate probate disputes — will contests, removal of personal representatives, breach of fiduciary duty, and competing petitions for appointment. Firms that only handle transactional probate administration will refer contested matters elsewhere. We do not.

  • Dual Florida Supreme Court Certified Mediators

Both partners are Florida Supreme Court Certified Circuit Court Mediators. When a dispute can be resolved without full litigation, we pursue that path first — at a fraction of the cost and time.

  • Recognized by peers and the legal community

David A. Yergey III has been named Super Lawyers Rising Stars by Thomson Reuters in 2022, 2023, and 2024. Yergey & Yergey, P.A. received the 2021 John R. Hamilton Law Firm Award of Excellence from the Legal Aid Society of the Orange County Bar Association.

  • Active leadership in Florida estate law

Former OCBA Estate, Guardianship & Trust Committee Chair (2019, 2022, 2024) and current Secretary, FL Bar RPPTL Probate and Trust Litigation Committee. Our attorneys are not observers of probate law — they help shape how it is understood and practiced in Florida.

Our Practice in Detail

Five practice areas. One steady hand across all of them.

01

Probate & Estate Administration

Fla. Stat. § 735.201 · § 733

When a loved one dies, the Orange County Probate Division requires an orderly process for settling the estate — from filing the petition and notifying creditors to distributing assets to beneficiaries. We handle Summary Administration (estates under $75,000 under Fla. Stat. § 735.201), Formal Administration, will contests, removal of personal representatives, breach of fiduciary duty, and ancillary estates for out-of-state decedents with Florida property.

02

Guardianship

Fla. Stat. § 744 · ETG · Plenary · Limited

Florida guardianship proceedings — from Emergency Temporary Guardianship under Fla. Stat. § 744.3031 to plenary and limited guardianship — require an attorney who knows both the law and the local court. We have represented petitioners, respondents, and wards in the Orange County Circuit Court for more than two decades, including contested guardianship, removal of a guardian, and restoration of a ward's rights.

Estate Planning & Advance Directives

Wills · Trusts · POA · Healthcare Surrogate

A well-constructed estate plan is the best gift you can give your family. We draft wills, revocable and irrevocable trusts, special needs trusts, durable powers of attorney, living wills, and healthcare surrogate designations. David A. Yergey III's LL.M. in Taxation from the University of Alabama brings graduate-level tax analysis to complex estate structures — an advantage most Central Florida estate planning attorneys cannot offer.

04

Trust Administration

Fla. Stat. § 736.0802

When the grantor of a trust dies or becomes incapacitated, the successor trustee assumes legal duties that carry personal liability for missteps. We guide trustees through the full administration cycle and represent beneficiaries when a trustee has breached their fiduciary duty under Fla. Stat. § 736.0802.

05

Mediation

Florida Supreme Court Certified · Circuit Civil

Both partners — David A. Yergey, Jr. and David A. Yergey III — are Florida Supreme Court Certified Circuit Court Mediators. We offer mediation as a first-choice path to resolving probate, trust, and guardianship disputes without prolonged litigation. Other attorneys may contact us to serve as neutral mediator in estate and trust disputes.
