Probate, Estate, and Guardianship Attorneys Serving Orange County Since 1928
Four generations of the Yergey family have guided Central Florida families through their most consequential legal moments. Today, David A. Yergey III — LL.M. in Taxation, Florida Supreme Court Certified Circuit Court Mediator, and former Chairman of the OCBA Estate, Guardianship & Trust Committee — leads a firm that brings nearly a century of institutional knowledge alongside the advanced credentials the next generation of estate law demands.
Four Generations. One Firm. One Purpose.
In 1928, C. Arthur Yergey opened a law practice in Orlando. What followed was not a marketing strategy — it was a family. D. Arthur Yergey joined in 1957. David A. Yergey, Jr. joined in 1983. David A. Yergey III joined in 2014. Each generation served the same Central Florida families through the same core belief: that the people who trust you with their most difficult legal moments deserve to be treated as clients for life, not matters to be closed. Our work is not limited to documents and court filings. We stand beside families in grief, in conflict, and in transition — and we hold ourselves to a standard of precision and advocacy that reflects the weight of what you are going through.
WHERE WE MAKE A DIFFERENCE
When a loved one dies, the Orange County Probate Division requires an orderly process for settling the estate — from filing the petition and notifying creditors to distributing assets to beneficiaries. We handle Summary Administration (estates under $75,000 under Fla. Stat. § 735.201), Formal Administration, will contests, removal of personal representatives, breach of fiduciary duty, and ancillary estates for out-of-state decedents with Florida property.
Florida guardianship proceedings — from Emergency Temporary Guardianship under Fla. Stat. § 744.3031 to plenary and limited guardianship — require an attorney who knows both the law and the local court. We have represented petitioners, respondents, and wards in the Orange County Circuit Court for more than two decades, including contested guardianship, removal of a guardian, and restoration of a ward's rights.
A well-constructed estate plan is the best gift you can give your family. We draft wills, revocable and irrevocable trusts, special needs trusts, durable powers of attorney, living wills, and healthcare surrogate designations. David A. Yergey III's LL.M. in Taxation from the University of Alabama brings graduate-level tax analysis to complex estate structures — an advantage most Central Florida estate planning attorneys cannot offer.
When the grantor of a trust dies or becomes incapacitated, the successor trustee assumes legal duties that carry personal liability for missteps. We guide trustees through the full administration cycle and represent beneficiaries when a trustee has breached their fiduciary duty under Fla. Stat. § 736.0802
Both partners — David A. Yergey, Jr. and David A. Yergey III — are Florida Supreme Court Certified Circuit Court Mediators. We offer mediation as a first-choice path to resolving probate, trust, and guardianship disputes without prolonged litigation. Other attorneys may contact us to serve as neutral mediator in estate and trust disputes
